Trade Mark Registration: Filing and Prosecution

We take the time to get to know your business and design a trademark portfolio that’s right for you.

Build a trade mark portfolio properly and the benefits are many. Get it wrong, though, and the mistake can be costly. That’s why we take the time to get to know your business and your market from the start. And develop a tailored strategy to give your brands the right protection, in the right places.

Trade Mark Protection

Investing in brand protection and obtaining the correct trade mark protection via registration will be invaluable in the long run, enabling you to enforce your trade marks in the future and adding significant value to your business, whilst protecting your reputation.

We can represent you at the UK Intellectual Property Office and the European Union Intellectual Property Office. And if required, we have the global connections with attorneys around the world to obtain trade mark protection in any overseas territories.

"From advising on viability and preparing applications, through to filing and eventual registration, we’ll work with you at every stage of the trade mark process to ensure you have adequate brand protection."

Trade Mark Applications

Trade mark protection is territorial and to register a trade mark it is necessary to apply for a trade mark registration in each country or territory, by filing a trade mark application with the official body responsible for granting intellectual property rights in the particular territory of interest.

We provide a full trade mark filing service, [including foreign trademark filings via a network of trusted overseas firms] and we will assist in preparing the trade mark applications to ensure that they meet all the requirements. Trade mark protection in the UK may be secured through registration at the UKIPO.

Trade Mark Prosecution

Once your trade mark application has been filed at the UK IPO, it will be examined to determine whether or not it meets all the requirements of the law. If the requirements are met, your application will be accepted for registration and published for opposition purposes in the Trade Marks Journal. If no oppositions are filed (or the application is not successfully opposed in its entirety), your application will proceed to grant and a certificate of registration will be issued.

Trade Mark Prosecution Process

We will provide assistance and advice at each stage of the trade mark prosecution process, so if any problems do arise we can deal with these straight away and resolve any potential disputes at an early stage.

Whether it’s helping determine the right specification of goods and services, or identifying potential new markets for future consideration, we’ll ensure your trade marks are filed in the most relevant and appropriate way.
